This
article analyzes the current state of Vietnamese law on copyright protection
for online journalistic works in the context of the 2025 amendments to the
Intellectual Property Law. Based on a survey of four groups of legal
tools—self-protection rights, technological measures and information management
of rights, reasonable citation exceptions, the responsibility of intermediary
service providers, and the direction of building a copyright database—the
article points out that current law has made significant progress compared to
previous periods, especially in approaching international standards such as the
Berne Convention and the WIPO Copyright Treaty. However, the legal framework
remains general, lacking specific regulations for the multi-platform and
multi-format exploitation of digital journalistic works, particularly regarding
technical standards, a clear "notification-removal" mechanism, and a
mechanism for sharing benefits when works are exploited secondarily. Based on a
comparison of the experiences of the United States (DMCA) and the European
Union (Article 15 of Directive (EU) 2019/790) [5],
this article proposes several directions for improving legislation to more
effectively protect copyright for online journalistic works in the digital
environment.
